1About these terms
These terms of service ("Terms") apply when you visit spidot.com (the "Site"), buy a travel eSIM or top-up from us, or use any related service (together, the "Service"). The Service is operated by Switas Tech Inc., a company with its address at 490 Post Street, Ste 500 PMB 2288, San Francisco, CA 94102, USA ("Spidot", "we", "us" or "our"). Spidot is our brand.
By placing an order or using the Service you agree to these Terms. If you do not agree, please do not use the Service. Our Privacy policy, Cookie policy and Refund policy also apply and form part of these Terms.
If you buy for a company or other organisation, our Business terms apply to that purchase instead of these Terms where the two differ. Resellers and referral partners are covered by the Partner and reseller agreement.
2Who can use the Service
- You must be at least 18 years old, or the age of majority where you live, to place an order. A parent or guardian may buy an eSIM for a child's device and is responsible for its use.
- You must give us a valid email address that you can access. We deliver your eSIM and receipt there.
- You must not be barred from receiving the Service under the laws that apply to you, including sanctions and export control laws.
Türkiye
We do not offer purchases to residents of Türkiye or to customers ordering from Türkiye. We may decline or cancel, and refund, any order that we reasonably believe is placed from Türkiye or by a resident of Türkiye. This does not affect plans whose coverage includes Türkiye for travellers who bought them elsewhere.
We may also refuse an order where we suspect fraud, where the payment cannot be verified, or where supplying the Service would break the law or the rules of our network partners.
3What you are buying
An eSIM is a digital SIM profile that you install on a compatible device. Our eSIMs give you mobile data for travel. They are data-only unless the plan is labelled "Data + calls". A data-only eSIM does not come with a phone number for normal calls or SMS.
We sell these kinds of plans. The plan page shows the exact data amount, validity, coverage and price before you pay:
- Fixed data: a set amount of data that is valid for a set number of days. Data stops when you use it all or when the validity ends, whichever comes first.
- Unlimited: unlimited data for a set number of days, subject to fair use. After heavy use on a given day, the network may slow your speed (see section 7).
- No-expiry: a set amount of data with no validity period. It lasts until you use it, unless the line is inactive for so long that the network withdraws it, as stated on the plan page.
- Data + calls: data, calls and SMS for set destinations (currently in Europe) for a set number of days, as described on the plan page.
Coverage and networks. Each plan page lists the countries it covers, the mobile networks it uses and where its IP address is located. The Service is provided over third-party mobile networks through our wholesale eSIM supplier. Which network you connect to, and the speed and coverage you get, depend on those networks, your location, your device and local conditions. We do not guarantee coverage everywhere in a country, or any particular speed. Networks may change; we keep plan pages up to date as far as we reasonably can.
Activation. Some plans start their validity when you install the eSIM or when it first connects to a supported network in the destination; others start when you buy. The plan page and your order page say which applies.
4Your device
To use our eSIMs your device must support eSIM and be carrier-unlocked (not locked to a single mobile operator). Some models sold in some countries do not support eSIM even when other versions do. You can check your device on our compatibility page, but the device maker and your home operator have the final word.
When you place an order you confirm that your device is compatible and unlocked. You also need an internet connection (for example Wi-Fi) to install the eSIM. We cannot refund an eSIM that does not work because the device is not compatible or is locked (see the Refund policy).
Most eSIMs can be installed only once. If you delete an installed eSIM from your device, it usually cannot be installed again. Please follow our install guides and do not delete the eSIM until you have finished using it.
5Ordering and prices
You order on the Site. You do not need an account. When you click to pay, you make an offer to buy the plan shown. A contract is formed when we confirm your order by showing the order page or sending the confirmation email. We may decline an order before then, for example if the plan is no longer available or we cannot supply it; if you have already paid, we refund you in full.
Prices are shown in US dollars (USD) unless the Site shows another currency. Prices include or exclude applicable taxes as shown at checkout; the total you pay is shown before you confirm. Your bank or card issuer may charge fees for currency conversion or foreign transactions; these are outside our control.
Payment is taken at the time of order through our payment processor, Stripe, by card, Apple Pay or Google Pay, or any other method shown at checkout. We do not see or store your full card number.
If a price on the Site is clearly wrong because of an obvious error, we may cancel the order and refund you in full, even after confirmation. We will tell you if this happens.
6Delivery
We deliver your eSIM digitally, usually within minutes after payment: the QR code and the manual activation details appear on your order page and are sent to the email address you gave at checkout. Please check your spam folder if you do not see the email.
If we cannot deliver your eSIM within a reasonable time after payment, we will tell you and, at your choice, keep trying or refund you in full. If you have not received your eSIM within 24 hours, contact us at support@spidot.com.
Keep your QR code private. Anyone who has it may be able to install your eSIM. We are not responsible for an eSIM installed by someone else using a QR code that you shared or did not keep safe.
7Fair use and acceptable use
Our plans are for personal travel use on a phone, tablet or similar device. Unlimited plans are subject to fair use: after heavy use within a day the network may reduce your speed for the rest of that day. The plan page states any daily high-speed allowance and the reduced speed where our supplier gives us that information.
You must not use the Service, or let anyone else use it:
- for anything illegal, fraudulent or harmful, or to infringe anyone's rights;
- to send spam, run bulk or automated messaging, or carry out attacks on networks or systems;
- in SIM boxes, routers for permanent fixed connections, or other equipment that resells or redistributes the connection, unless we have agreed this in writing;
- to resell or commercially redistribute eSIMs, except under our Partner and reseller agreement or Business terms;
- in a way that breaks the rules of the mobile networks we use, or harms the Service or other users.
If you break these rules, we or the network may slow, suspend or end your eSIM (see section 12). You must also follow local laws in the places you travel to.
8Top-ups
Where the Site offers it, you can add data to an eSIM you have already installed by buying a top-up. A top-up applies to that eSIM only, has its own data amount and validity as shown before you pay, and cannot be moved to another eSIM. Top-ups are delivered to the existing eSIM: there is nothing new to install. Top-ups are refundable only if they have not been used, as set out in the Refund policy.
9Signing in
You can buy without an account. If you want to see your eSIMs, data usage and receipts in one place, you can sign in with Google or with a one-time link that we email to you. There is no password. You are responsible for keeping access to your email and Google account secure, and for activity in your session. Tell us at support@spidot.com if you think someone else has accessed your eSIMs.
10Business purchases and partners
Companies, travel agencies, airlines and other organisations can buy eSIMs in bulk for their travellers under our Business terms, together with our Data processing addendum where we process traveller data on their behalf. Organisations that want to resell or refer Spidot eSIMs can apply to our partner programme under the Partner and reseller agreement. Find out more on our business page.
11Our content and intellectual property
The Site, the Spidot name and logo, and all text, graphics, guides and software on the Site belong to us or our licensors and are protected by intellectual property laws. You may view and print pages for your personal, non-commercial use. You must not copy, scrape, reproduce or reuse them for any other purpose without our written permission. Names of devices, networks and other brands on the Site belong to their owners and are used only to describe compatibility and coverage.
12Suspension and termination
We may suspend or end your eSIM or your access to the Service, with notice where reasonably possible, if you seriously or repeatedly break these Terms, if we reasonably suspect fraud or misuse, if a payment is reversed or charged back without good reason, or if we are required to by law, a regulator or a network partner. If we end the Service for a reason that is not your fault, we will refund the unused part of your plan.
You can stop using the Service at any time. Deleting an eSIM does not by itself entitle you to a refund. Sections that by their nature should continue after the Service ends (for example on liability, intellectual property and disputes) continue to apply.
13Our promises and disclaimers
We will provide the Service with reasonable care and skill and as described on the plan page at the time you buy. If you are a consumer, you have legal rights in relation to digital content and services that are faulty or not as described. Nothing in these Terms affects those rights.
To the extent permitted by law, and apart from the promises above, the Service is provided "as is" and "as available". We do not promise that the Service will be uninterrupted, error-free, available in every location, or reach any particular speed, and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Mobile networks are run by third parties and may suffer outages, congestion or restrictions that we cannot control.
Some jurisdictions do not allow certain warranties to be excluded, so some of these exclusions may not apply to you.
14Our liability
Nothing in these Terms limits or excludes our liability where that would be unlawful, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for breach of your statutory rights as a consumer.
Subject to that, and to the extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential or punitive losses, or for loss of profits, business, revenue, data or opportunity, or for costs such as roaming charges from your home operator, missed connections or alternative communication costs; and (b) our total liability to you arising from or relating to an order is limited to the amount you paid for that order.
If you are a consumer in the European Union or the United Kingdom, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, and the limits above apply only as far as the law of your country allows.
We are not responsible for delays or failures caused by events outside our reasonable control, such as network outages, natural disasters, government action or failures of third-party providers. If such an event prevents us from delivering a plan you have paid for, we will refund you.
15Your responsibility for misuse
To the extent permitted by law, if you use the Service for business or in breach of these Terms, you agree to compensate us for reasonable claims, losses and costs (including reasonable legal fees) that arise from your breach of section 7 or your breach of the law. This does not apply to consumers in jurisdictions where such an obligation is not allowed.
16Changes to the Service and these Terms
We may change these Terms from time to time, for example to reflect changes in the law, our plans or how the Service works. The version that applies to your order is the one shown on the Site when you placed it. If a change affects a plan you have already bought, we will only make it if it does not reduce what you paid for, or we will tell you and you may ask for a refund of the unused part. We show the date of the latest version at the top of this page.
17Governing law and disputes
Please contact us first at support@spidot.com. Most problems can be solved quickly that way. If we cannot resolve a dispute informally within 30 days, the rules below apply.
These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law rules, and by the Federal Arbitration Act where it applies.
If you live in the United States
Arbitration and class action waiver. You and we agree to resolve any dispute arising from or relating to these Terms or the Service by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. There is no judge or jury in arbitration, and review of the decision is limited. You and we each waive the right to bring or take part in a class action, class arbitration or representative action.
- Either of us may instead bring an individual claim in small claims court if it qualifies.
- The arbitration will take place in the county where you live or by video or phone, unless we both agree otherwise. Fees are paid as set out in the AAA Consumer Arbitration Rules.
- Either of us may ask a court to stop the infringement or misuse of intellectual property.
- You may opt out of this arbitration agreement by emailing support@spidot.com within 30 days after you first accept these Terms, with your name, the email address you used and a statement that you opt out of arbitration.
- If the class action waiver is found unenforceable for a claim, that claim must be decided in court and not in arbitration. Otherwise, courts in San Francisco County, California have jurisdiction.
If you live outside the United States
If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country. If you live in the European Union, you may also use the alternative dispute resolution bodies available in your country. Businesses agree to the jurisdiction of the state and federal courts in San Francisco County, California.
18General
- If any part of these Terms is found to be unenforceable, the rest continues to apply.
- If we do not enforce a right straight away, we can still enforce it later.
- You may not transfer your rights under these Terms without our consent. We may transfer ours to another company that takes over the Service, without reducing your rights.
- These Terms, together with the policies they refer to, are the whole agreement between you and us about the Service.
- We communicate with you in English, by email or on the Site.
